Following the breakup of Timbuk 3 and the dissolution of his marriage with musical partner Barbara K., Pat MacDonald signed with Ark 21, a new label founded by the former head of IRS. The resulting record was an eerily intense song cycle that traded Timbuk 3's pop songcraft and wry social commentary for subdued, almost minimalist arrangements and profoundly personal lyrics. Musically, the disc is so low-key that some tracks barely register; the droning, somnambulant melodies of "Smoke" and "Seven" come across as mere vehicles for MacDonald's deft wordplay rather than fully developed songs. MacDonald's low-tuned acoustic guitar and world-weary vocals are at the forefront, sometimes unadorned (as on an illuminating solo version of his Timbuk 3 song "Daddy's Down in the Mine") and elsewhere backed by foot stomps or basic percussion. The whole thing has a foggy, ethereal feel, as if all the sessions had taken place in the hours between midnight and dawn. That shouldn't be taken as a criticism, since it lends a certain weightiness to intimate MacDonald compositions like "You Left Something." And it doesn't hurt that, amid all the darkness, there are occasional moments as accessible as anything MacDonald's previous band recorded; "Thanks for Comin'" and "Like Water" are smart pop tunes that show he could still pen an ear-catching melody and work an irresistible groove. Be a Food Shopping Organizer

Have you ever gone shopping and then at home you realized that you forgot something. This happens ever day by thousands of people so you are not alone. Did you forget to take your coupons or didn't give them to the cashier at checkout?

It's now time to focus your organizational skills on your grocery shopping and keep the money in your pocket. Here are ideas to support you on this road.

Planning your food shopping trips

-Start by collecting the flyers from the supermarkets you normally shop at. By checking your flyers first you see what is on sale and then you can create your weekly meals to include the sale items. For example, if chicken is on sale, chicken will be on the menu this week. If you love salmon and it's on sale...then treat yourself without breaking the bank.

-Coupons - start collecting them from newspapers or even download them from the internet and add more savings to your grocery budget.

-Create a system to keep your coupons organized. Purchase a coupon organizer to house all those great deals. Though only keep coupons for those products that you actually use. Sometimes even with a brand name product coupon it's still cheaper to purchase the store brand. If you are going to buy the brand name anyway, then definitely take the savings.

-On the day you are organizing your shopping list, check the expiration date of your coupons. In my coupon organizer, I have a section that says, "expiring soon." Depending on how often you shop, this can be within a week, two weeks or a month. You go there first to stock up on your favorite foods or household products...don't want to lose those savings.

Get into the habit of planning your meals out each week. Choose a day of the week to do your shopping and stick to it. The day before is when you organize your menus.

-Once you've completed your menu, you can create your shopping list.

-It's also important to take a current inventory of your pantry and add any staples that are running low.

-Keep a shopping list posted to your bulletin board or refrigerator where each family member can let you know what food or product is out or almost empty.

-Create a shopping list that is similar to the layout of your store. If there are several stores that you go to, then you will need to organize your list by store.

-The internet has free shopping lists, though I find creating on the computer your own customized list works fine. Create three columns: one for the product, one for whether it's on sale and the last column to indicate if you have a coupon.

-Attached your coupons and any ads to your shopping list....in case there are discrepancies in the store.

-Bring a calculator to keep track of your bill...don't want to be surprised at the register.

Hint: Stores are set up that your milk and bread are in the back...so you have to pass many other products before getting there. How many times have you gone in for just milk and impulsively bought something else and you paid the full price. Weekly planning will keep you focused on the sales and savings.

You are now organized: flyers, coupons, menus and shopping list. If you are just starting the "organized" path of food shopping, it will seem like a lot of work. After a few weeks, you will become more efficient and the process will not take as long.

If you really want to motivate yourself, keep a log of the amount you saved each week. If your budget allows, treat yourself to something special with your savings.

Estate Planning and the Forgotten Right to Recapture Copyrights: How Not to Overlook this Important Right

If your client's estate plan overlooks the right to terminate contracts and recapture copyrights, it could cost your client's heirs significant future income. Let's take for example that you have a client who wrote a children's book and signed a publishing contract in 1965. The copyright was secured that same year and your client transferred all his interest in the copyright to the publisher. For estate purposes, you may be thinking there is nothing there of value except for any income that your client is receiving and may continue to receive after his death pursuant to the contract terms. If the thought crossed your mind, you are likely overlooking a very important right that could be costly to your client and his heirs.

Under the Copyright Act of 1976, the author, or if deceased, the author's widow or widower and children or grandchildren may terminate all transfers or licenses of the renewal copyright or any right under it (for pre-1978 copyrights) at the end of 56 years from the date the copyright was originally secured and recapture the last 39 years of copyright protection (*provided the contract was executed prior to January 1, 1978 and timely notice of termination is provided*). Congress made the right of termination inalienable. Therefore, any contract terms to the contrary have no effect.

In your client's case, the 56th year is 2021 and the copyright in his work extends until 2060. Therefore, there is the possibility that his heirs may acquire the right to terminate the contract and recapture the copyright. If the estate documents are silent regarding this right, the heirs may miss the opportunity. If they are aware of the right, they could renegotiate the contract or take back the copyright and the exploit the work themselves or enter into more lucrative contracts thereby taking advantage of the termination right to derive more income from the work's copyright.

If the opportunity to terminate and recapture is missed, there is another chance to recapture the copyright for the last 20 years of protection (* if timely notice is provided*); however, your client or his heirs will lose the benefit of potential income derived from exploiting the copyright in the work during those 19 years between the 56th year and the 75th year of protection.

Also Beware of Traps: There is a limited window of opportunity to terminate and the *notice* requirements are highly technical. There are also traps, such as the right to terminate does not apply to works-for-hire and the right of termination for post-1977 works is different. Therefore, if you are dealing with this issue with regard to any works protected by copyright (not just pre-1978 literary works as described above) make sure that you have thoroughly researched all the requirements, including the notice requirements and have planned accordingly, or contact an attorney who is familiar with this area of law.
